Dr. Ssali to Defend Himself Over Patient’s Death

Court at Buganda Road ordered gynecologist,\r\nDr. Edward Tamale Ssali, to defend himself over allegations of negligence that\r\nled to death of a patient two years ago.

The Chief Magistrate, Her Worship Olive Kazaarwe\r\n‘s ruling on November 6, 2013 arose after  prosecution adduced five witnesses who\r\ntestified, proving to court that the doctor had a case to answer.  "Basing on the current prosecution evidence,\r\nthis court finds that all the accused persons have a case to answer in\r\nconnection to the death of one Mercy Ayiru, whom they allegedly operated on in\r\n2010,” Her Worship Kazaarwe said.

One of the chief\r\nprosecution witnesses, Dr. Sylvester Onzivua of Mulago hospital, a forensic\r\npathologist who conducted a post-mortem on the deceased, told court that the\r\nsuspects’ negligence caused Ayiru’s death because they inserted the anesthesia\r\ntube into her throat instead of the trachea.

Dr. Ssali, the proprietor of Women’s Hospital\r\nInternational and Fertility Centre in Bukoto, a Kampala suburb, is facing these\r\ncharges alongside Mr. Christopher Kirunda, an anesthetist at the fertility\r\ncentre and, Dr. Rafique Parker, who is based in Nairobi and also faces\r\nadditional charges of operating in Uganda without a license.

\r\n\r\n

The Chief Magistrate\r\nadjourned the matter to December 9, 2013.
